Questioning the Judge Selection Process
One crucial point raised in the lawsuit concerns how judges are chosen within the Department of Justice (DOJ) to handle cases related to employment discrimination against immigrants. SpaceX argues that this process has flaws and might jeopardize their right to a fair trial.
A Long-Lasting Legal Dispute
This legal battle between the DOJ and SpaceX has been ongoing for several years. Just last month, the DOJ accused SpaceX of not hiring individuals who were not US citizens or green card holders between 2018 and 2022.
Hiring Non-US Citizens
In response, SpaceX and Elon Musk stated that they employ many non-US citizens. However, they acknowledge that some of their projects have national security implications, which could result in substantial fines due to the employment of foreign workers.
Referencing a 2022 Case
SpaceX's lawsuit also mentions a 2022 Federal Court case involving the SEC, where it was ruled that conducting internal enforcement proceedings was unconstitutional. In the current lawsuit, SpaceX argues that DOJ administrative judges, appointed by the US attorney general, have powers that should only be held by officials appointed directly by the president.
This legal battle is expected to gain significant attention in the coming months as SpaceX works to defend its hiring practices and protect its rights under the Constitution.
